Terms of Service

1. Who we are and these terms

The Team Breakthrough app ("the App") is operated by Oxygen Therapy South West Limited, a company incorporated in England and Wales (company number 15557769), whose registered office is at Woodstream, The Ley, Box, Corsham, England, SN13 8EW ("we", "us", "our"). The "Team Breakthrough" trade name and branding are used under licence from Team Breakthrough Limited.

These Terms of Service ("Terms") govern your access to and use of the App and any services we provide through it. By creating an account or using the App you agree to these Terms. If you do not agree, please do not use the App.

These Terms should be read together with our Privacy Policy.

2. Eligibility

You must be at least 18 years old and have legal capacity to enter into a binding contract to use the App. By signing up you confirm that you meet these requirements.

3. Your account

When you create an account you must provide accurate, current and complete information. You are responsible for keeping your password confidential and for all activity that takes place under your account. Notify us immediately at info@breakthroughgym.co.uk if you suspect any unauthorised use of your account.

You may delete your account at any time directly from the Profile page in the App. Account deletion is permanent and unrecoverable.

5. Wellness Points

5.1 Wellness points can be purchased through the App or through our website using a Stripe payment link. The current packs and prices are shown in the App at the time of purchase.

5.2 Wellness points are non-refundable, except where required by law or otherwise stated in these Terms. Purchasing a pack is a final sale. If you have a complaint about a points purchase, please contact us at info@breakthroughgym.co.uk and we will investigate.

5.3 Wellness points are valid for 12 months from the date of purchase, after which they expire and are no longer redeemable. The expiry date for each pack is shown in your wallet.

5.4 Points cannot be transferred between accounts, converted to cash, or combined with payments from another member's wallet.

5.5 Promotional and bonus points (for example, welcome bonus, birthday bonus, review bonuses, referral bonuses) are gifts from us and have no cash value. We may withdraw, modify or expire bonus points at our discretion in exceptional circumstances (such as suspected fraud or abuse of the referral system).

5.6 If you delete your account, any remaining wellness points (whether purchased or bonus) are forfeited at the point of deletion. We will not provide refunds for points that are lost in this way.

6. Bookings and cancellations

6.1 When you book a treatment through the App, you enter into a contract with us to receive that treatment at the date and time chosen.

6.2 To cancel or reschedule a booking, we require at least 24 hours' notice before the start of your appointment. Cancellations made through the App at least 24 hours in advance will result in the points or payment being returned to your wallet or card automatically.

6.3 Cancellations made less than 24 hours before the appointment, or non-attendance, will not be refunded.

6.4 We reserve the right to cancel a booking in exceptional circumstances (for example, equipment fault, staff illness, or facility closure). In such cases we will contact you to arrange a refund or rebooking, at your choice.

7. Payments

7.1 Payments for wellness packs, treatments and Biohack experiences made through the App are processed by Stripe Payments Europe Ltd. By making a payment you agree to Stripe's terms.

7.2 Payments made by Direct Debit (for example, for gym memberships managed through TeamUp) are not within the scope of these Terms — those are governed by separate agreements with Team Breakthrough Limited and TeamUp.

7.3 All prices are shown in GBP (£) and include any applicable VAT.

8. Health and safety; not medical advice

8.1 The wellness treatments we offer (such as HBOT, cryotherapy, infrared sauna, and others) are recreational wellness services and are not a substitute for professional medical advice, diagnosis or treatment.

8.2 If you have any underlying health condition, are pregnant, are taking medication, or have any concerns about your suitability for any treatment, please speak to your GP or appropriate medical professional before booking.

8.3 You agree to disclose to our staff any medical condition, contraindication or recent injury that may affect your safety during treatment. We may decline to perform a treatment if we believe, in our reasonable judgement, that it is unsafe to do so.

8.4 You acknowledge that wellness treatments are taken at your own risk.

We reserve the right to suspend or close accounts that breach these rules, with forfeiture of any unused points where appropriate.

10. Referral system

10.1 Members may earn bonus points by referring new members. Each referral bonus is paid only after the referred member's first qualifying purchase, as described in the App.

10.2 Referral bonuses are personal to the referrer and the referred member. We may withhold or revoke bonuses where we reasonably believe the referral system has been abused.

11. Intellectual property

The "Team Breakthrough" name, logo and brand identity are the property of Team Breakthrough Limited and are used under licence. The App, its design, content and software are owned by us or our licensors. You may not copy, modify or distribute any part of the App without our written permission.

12. Limitation of liability

12.1 Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be limited or excluded as a matter of law.

12.2 Subject to clause 12.1, our total liability to you arising out of or in connection with these Terms is limited to the total amount you have paid to us in the 12 months immediately preceding the event giving rise to the liability.

12.3 We are not liable for indirect or consequential losses, loss of profits, loss of business, or losses arising from circumstances outside our reasonable control.

13. Termination

13.1 You may delete your account at any time as described in clause 3.

13.2 We may suspend or terminate your account if you materially breach these Terms. Where reasonable to do so, we will give you notice and an opportunity to remedy the breach first.

13.3 The provisions that by their nature should survive termination (including those concerning intellectual property, limitation of liability, and governing law) will continue in force.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will notify you by email and update the "Last updated" date above. Continued use of the App after a material change indicates your acceptance of the updated Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
